You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the business you represent. By using the Service, you represent that you meet these requirements.
Chesera provides tools to capture inbound leads via SMS, automate follow-up, and assist with AI-powered messaging. Features may include SMS auto-capture, AI follow-up, ad-to-conversation integrations, and missed call rescue (where available). We may modify, suspend, or discontinue features at any time.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and notify us promptly of unauthorized use.

Free trials and paid plans are subject to the pricing and features displayed at sign-up. We may change pricing with notice where required. Failure to pay applicable fees may result in suspension or termination of access.
Chesera and its licensors own all rights in the Service, including software, branding, and content. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
You retain ownership of content you submit through the Service. You grant Chesera a license to host, process, and display such content solely to provide and improve the Service, including AI-assisted features.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, OR SPECIFIC LEAD CONVERSION RESULTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHESERA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO CHESERA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold Chesera harmless from claims arising from your use of the Service, your messages to end users, or your violation of these Terms or applicable law.
We may suspend or terminate your access at any time for violation of these Terms or for any reason with notice where required. You may stop using the Service at any time. Provisions that by nature should survive termination will survive.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved in the courts located in Delaware, unless otherwise required by applicable law.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
